Firm Founded in 2009

Daily Aljian was founded by attorneys Reed Aljian and Justin Daily in 2009. The two attorneys met in law school and, after graduation, pursued their careers separately at prestigious law firms.

Grounded Advice Rooted in Local Experience

Reed gained experience in the trial department of two international law firms in Los Angeles and Orange County. Justin started at a boutique law firm in San Diego and later worked as an Orange County Deputy District Attorney before opening his own practice in Newport Beach.

Quality Over Quantity

When Justin and Reed started their own firm, they agreed on one philosophy: provide the highest quality work available at a reasonable rate or, stated another way, quality over quantity.

Depending on the matter, your case may proceed through motions, hearings, mediation or arbitration, trial, and, if needed, appeals. Our attorneys advocate on your behalf at every stage, including settlement negotiations or trial before a judge or jury under California procedural rules.

FAQs About Employment Litigation Law

How long does a civil lawsuit typically take in California?

The timeline depends on the complexity of the case, the court’s schedule, and whether the matter resolves through settlement. In Orange County Superior Court, many civil cases take several months to more than a year, especially if they proceed through discovery and trial. Early resolution is sometimes possible through negotiation or mediation.

Can my case be resolved through mediation or arbitration?

Yes. Mediation is a voluntary settlement conference facilitated by a neutral third party. Arbitration is a more formal process where an arbitrator issues a binding or nonbinding decision. Some contracts require arbitration, particularly in business or employment disputes. You should talk to your lawyer about these options to see if they can help resolve your case.

What is the difference between litigation and trial?

Litigation refers to the entire legal process, from filing a complaint through discovery, motions, and potential settlement discussions. Trial is one stage within litigation where a judge or jury hears evidence and issues a decision if the case does not resolve beforehand.

What damages can be recovered in a civil case?

Depending on the claim, damages may include economic losses such as lost profits or medical expenses, as well as noneconomic damages like emotional distress. In certain cases, punitive damages may be available under California law to address malicious and wrongful conduct.

Do all cases go to trial?

No. Many business, employment, real estate, and personal injury matters resolve before trial through settlement, mediation, or arbitration. However, having experienced trial counsel is critical because preparation and readiness to try a case often influence the outcome of negotiations.

What happens if I am served with a lawsuit?

You must respond within a specific time frame, typically 30 days in California state court. Failing to respond can result in a default judgment. An attorney can evaluate the complaint, determine appropriate defenses, and file a timely response on your behalf.

What is discovery, and why is it important?

Discovery is the formal exchange of information between parties. It may include written questions, document production, and depositions. Discovery allows each side to evaluate the strengths and weaknesses of the case and often plays a central role in shaping settlement discussions or trial strategy.

How are attorney’s fees handled in litigation matters?

Fee structures vary by practice area and case type. Some matters are handled on an hourly basis. Others may be handled on a contingent fee; i.e., the Firm is paid a percentage of the recovery. In limited situations, California law or contractual provisions may allow the prevailing party to recover attorney’s fees.

What are my obligations once a lawsuit is filed?

You may be required to preserve relevant documents, respond to written discovery requests, appear for depositions, and attend court hearings. Prompt communication with your attorney and timely cooperation are essential to protecting your position.

What should I bring to my initial consultation?

Bring any contracts, correspondence, court documents, insurance policies, photographs, or other materials related to your matter. A written timeline of events and a list of key individuals involved can also help your attorney quickly assess the legal and strategic considerations.
